These Terms & Conditions (“Terms”) govern your access to and use of www.nucleartheranostics.com (the “Website”) and the services offered on it, which are operated by Theranostic Physicians Private Limited (“TPPL”, “we”, “us” or “our”), a company incorporated in India under the Companies Act, 2013 (CIN U86201DL2024PTC434517), with its registered office at N-5, D Block, Saket, New Delhi 110017, and clinical operations at the Department of Nuclear Medicine & Molecular Imaging, Lower Ground Floor, Fortis Memorial Research Institute, Sector 44, Gurugram, Haryana 122002.
By accessing or using the Website, or by requesting or using any service offered on it, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Website or the services.
Not a substitute for professional care, and not for emergencies. The Website and its information do not constitute medical advice, diagnosis or treatment and are not a substitute for consulting your own qualified healthcare provider. If you have or suspect a medical problem, contact a qualified health professional. In a medical emergency, dial 112 in India (or your local emergency number) or go to the nearest hospital immediately. Do not use the Website to seek emergency or time-critical care.
1. Acceptance & changes
These Terms form a binding agreement between you and TPPL. We may modify these Terms at any time by posting the revised version on this page with an updated “Last updated” date. Changes are effective when posted. Your continued use of the Website or services after a change constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically. Certain services may also require you to accept additional service-specific terms or consents before you can use them.
2. Definitions
- “Services” means the Online Consultation Service, the Second Read Service, PET Scan Booking Facilitation, and any other service offered through the Website.
- “RMP” means a Registered Medical Practitioner enrolled with the National Medical Commission or a State Medical Council under applicable law.
- “Facility” means a hospital, diagnostic centre or laboratory at which a scan, procedure or treatment is performed, including Fortis Memorial Research Institute (“FMRI”), Sector 44, Gurugram.
- “You” / “User” means the person accessing the Website or requesting a Service, including a parent or lawful guardian acting for a patient.
- “TPG 2020” means the Telemedicine Practice Guidelines, 2020 (Appendix 5 to the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002), as amended and as administered by the National Medical Commission.
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Website and the Services on your own behalf. A Service concerning a patient who is a minor or who lacks capacity must be requested and authorised by the patient’s parent or lawful guardian, who accepts these Terms on the patient’s behalf and is responsible for the information provided. By using a Service you confirm that the information you provide is true, accurate, current and complete.
4. No medical advice; no doctor–patient relationship from the Website
The general content of the Website (articles, descriptions, publications and educational material) is provided for information only and does not create a doctor–patient relationship between you and TPPL or any clinician affiliated with us. Merely browsing the Website, reading its content, or sending a general enquiry does not establish such a relationship and must not be relied upon as medical advice for your specific situation.
The two clinical services differ in their nature, and the distinction matters legally. An Online Consultation is a teleconsultation with a Registered Medical Practitioner conducted under the NMC Telemedicine Practice Guidelines, 2020, and does establish a limited doctor–patient relationship, confined to that consultation. The Second Read Service, by contrast, is an imaging-review service only: it provides radiological observations for clinical correlation by your treating physician and does not establish any doctor–patient relationship and does not constitute a diagnosis or treatment advice. In every case, responsibility for your overall diagnosis, treatment and ongoing care remains with your treating physician. The precise scope, and the terms that govern each service, are set out in that service’s own Service-Specific Terms (see Section 5 and the Service Terms below).
5. The services we offer
Through the Website we offer:
- Online Consultation — a scheduled online clinical consultation with a Registered Medical Practitioner, conducted under the NMC Telemedicine Practice Guidelines, 2020. Governed by the Online Consultation Terms & Conditions (see Service Terms A);
- Second Read Service — an independent imaging review of PET-CT and related imaging, based on the materials you provide, giving radiological observations for clinical correlation by your treating physician (it is not a diagnosis and creates no doctor–patient relationship). Governed by the Second Read Service Terms & Conditions (see Service Terms B);
- PET Scan Booking Facilitation — coordination and concierge assistance to arrange a PET-CT scan or appointment at a Facility, where the scan itself is performed by the Facility, not by TPPL, and for which TPPL charges no fee or commission (see Service Terms C).
Service-Specific Terms prevail. The Online Consultation Service and the Second Read Service are each governed by their own Service-Specific Terms, published at the links above, which you must read and accept before using that service. Those Service-Specific Terms supplement these Terms; in the event of any conflict between these Terms and a service’s Service-Specific Terms in respect of that service, the Service-Specific Terms prevail.
We may add, change, suspend or withdraw any Service, in whole or in part, at any time.
6. Accuracy of information
We take reasonable care to keep the Website accurate and current, but we do not warrant that the content is complete, accurate, up-to-date, or reflects the most recent research or clinical guidelines. The Website may contain typographical errors, inaccuracies or omissions, which we may correct at any time without notice. You should not rely on the Website’s content to make medical decisions without consulting a qualified healthcare provider.
7. Your obligations
You agree that you will:
- provide true, accurate, complete and current information, and update it as needed;
- only submit medical images, reports or records that relate to you, or that you are lawfully authorised to share, and confirm you have any necessary consent of the patient to do so;
- not impersonate any person or misrepresent your identity, age or authority;
- use the Services only for lawful, personal, non-commercial purposes; and
- follow the instructions and safety information provided to you for any Service.
You acknowledge that you are responsible for your own health decisions and for sharing the outputs of any Service (such as a report or advice) with your treating physician.
8. Accounts & credentials
Where a Service requires registration or access credentials, you are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate access where we reasonably believe information is untrue or these Terms have been breached.
9. Fees, payment, cancellation & refunds
- Fees. Fees for each Service are those displayed to you at the point of booking or as otherwise quoted to you in writing before you pay. Fees are inclusive or exclusive of applicable taxes as indicated at checkout.
- Payment. Payments are processed by third-party payment providers. You represent that you are authorised to use the payment method and that the information you provide is accurate. We may refuse or cancel a request where payment cannot be verified or where we reasonably suspect misuse.
- Scan and treatment charges are separate. Charges for a scan, procedure or treatment performed at a Facility are billed by that Facility under its own rates and policies. TPPL charges no facilitation fee or commission for arranging a PET-CT scan or appointment (Service Terms C).
- Cancellation & refunds. Cancellation, rescheduling and refund terms are set out in the relevant Service-Specific Terms — for the Online Consultation and Second Read Services, in their own published terms, which prevail in case of conflict. Except as stated there or as required by law, fees for services already rendered are non-refundable. Nothing in these Terms affects your non-excludable rights under the Consumer Protection Act, 2019.
Service Terms A — Online Consultation
These additional terms summarise the Online Consultation Service. The Service is governed in full by the Online Consultation Terms & Conditions, which you must read and accept before using the Service and which prevail over these Terms in case of any conflict in respect of that Service.
A.1 Nature of the service
An Online Consultation is a scheduled online clinical consultation (a video or voice meeting, preceded by review of the records you upload and followed by a written summary), conducted under the NMC Telemedicine Practice Guidelines, 2020. It is delivered by a TPPL Consultant who is a Registered Medical Practitioner. As at the effective date, the Consultants are Dr. Ishita B. Sen (Reg. No. HMC-5237, Haryana Medical Council) and Dr. Dharmender Malik (Reg. No. DMC-84854, Delhi Medical Council). It establishes a limited doctor–patient relationship confined to that consultation, and is, by its nature, limited because no physical examination is performed.
A.2 Identity, consent & recording
Consistent with the NMC Guidelines, the Consultant verifies the identity of the patient and of the Consultant, and your consent to the consultation is obtained. Online Consultations are not recorded — neither audio nor video. You and the patient are likewise asked not to record the consultation.
A.3 Clinical discretion & prescriptions
The Consultant exercises independent professional judgment. The Consultant may decline to advise, may recommend an in-person examination or further tests, and may or may not issue a prescription, as clinically appropriate. Any prescription is issued in accordance with the NMC Guidelines and applicable law; certain categories of medicines (including those restricted under the Drugs and Cosmetics Act and rules, Schedule X drugs, and narcotic and psychotropic substances) are not prescribed by teleconsultation. There is no guarantee that a prescription will be issued, and the absence of a prescription is not a failure of the Service.
A.4 Eligibility, fees, scheduling & refunds
Eligibility requirements (including that the patient be physically located in India at the time of the consultation), the fee, payment, scheduling, rescheduling and refund terms are set out in the Online Consultation Terms & Conditions. An Online Consultation is not appropriate for emergencies or for conditions requiring physical examination or in-person care; if your condition is or becomes urgent, seek in-person emergency care immediately.
Service Terms B — Second Read Service
These additional terms summarise the Second Read Service. The Service is governed in full by the Second Read Service Terms & Conditions, which you must read and accept before using the Service and which prevail over these Terms in case of any conflict in respect of that Service.
B.1 Nature of the service — imaging review only
The Second Read Service is an independent radiological review of PET-CT and related imaging, based solely on the materials you provide. It produces an Imaging Review Report documenting the radiological observations visible on the images, for clinical correlation by your treating physician. It involves no physical examination of the patient.
B.2 What it is not
- It is not a medical diagnosis, a treatment recommendation, or medical advice, and it does not confirm or refute any diagnosis made by another physician.
- It does not create any doctor–patient relationship between you (or the patient) and TPPL or any TPPL physician, and no duty of care arises beyond providing the imaging review.
- Its findings have no standalone clinical meaning and must be clinically correlated by your treating physician, who retains sole responsibility for all clinical decisions. The Report is not for emergency use, and it may not be used for any medico-legal, forensic or legal purpose.
B.3 Dependence on your materials; warranties
The Report is entirely dependent on the quality, accuracy, completeness and authenticity of the materials you provide, which TPPL cannot independently verify. You confirm that you are the patient or are lawfully authorised to submit the patient’s images and records, that you have any consent required, and that the materials are authentic and relate to the patient.
B.4 Delivery, fees, refunds & data handling
Turnaround targets, the fee, the refund policy and the data-retention arrangements for this Service are set out in the Second Read Service Terms & Conditions. The Second Read Service is not an emergency or urgent-care service; if your situation is urgent, seek in-person care without waiting for the Report.
Service Terms C — PET Scan Booking Facilitation
These additional terms apply when you ask us to facilitate a PET-CT scan or appointment. They are to be read with the rest of these Terms.
C.1 Facilitation only — TPPL is not the diagnostic provider
Under this Service, TPPL provides coordination and concierge assistance only — for example, helping you schedule a PET-CT scan or appointment at a Facility (such as FMRI, Sector 44, Gurugram), and supporting logistics. The scan, procedure and its reporting are performed by the Facility and its own personnel, not by TPPL. The clinical and contractual relationship for the scan itself is between you and the Facility.
C.2 What TPPL is not responsible for
To the extent permitted by law, TPPL is not responsible or liable for: the performance, safety, timing or outcome of the scan or procedure; radiation exposure or any clinical effect; the accuracy of the Facility’s report; the Facility’s availability, rates, billing, policies, staff or equipment; or any act or omission of the Facility. Any complaint about the scan, procedure, report or hospital billing must be raised with the Facility under its own policies.
C.3 Charges — no facilitation fee
Scan and hospital charges are set and billed by the Facility and are payable to it. TPPL does not charge any facilitation fee, commission or mark-up for arranging a PET-CT scan or appointment — you pay only the Facility’s own charges, billed directly by the Facility. Cancellation, rescheduling and refunds for the scan are subject to the Facility’s own policies.
C.4 Your information
To arrange a booking we will share the information necessary with the Facility, which then handles your data under its own privacy policy (see our Privacy Policy, Sections 8 and 17).
10. User content & feedback
If you submit any content to us or the Website (such as enquiries, feedback, reviews or testimonials), you confirm that you have the right to do so and that the content is not unlawful, defamatory, obscene, infringing, harmful or misleading. You grant TPPL a non-exclusive, royalty-free right to use feedback and reviews you choose to make public for the purpose of operating and promoting the Services, subject to applicable law and our Privacy Policy. We may, but are not obliged to, monitor, edit or remove user content. Your medical records and the contents of your consultations are confidential and are governed by our Privacy Policy, not by this clause.
11. Intellectual property
The Website and its content — including text, design, graphics, logos, the “Nuclear Theranostics” and TPPL brand marks, publications, and the arrangement of all of the foregoing — are owned by or licensed to TPPL and are protected by Indian and international intellectual-property laws. You may view and print content for personal, non-commercial use only, provided you do not modify it, you keep all notices intact, and you do not use it in a way that suggests an association with or endorsement by TPPL. You may not copy, reproduce, republish, distribute, frame, scrape or create derivative works from the Website without our prior written consent.
12. Prohibited uses
You agree not to:
- use the Website or Services in violation of any applicable law;
- upload or transmit anything unlawful, infringing, defamatory, fraudulent, obscene, or harmful, or any virus or malicious code;
- impersonate any person or submit records you are not authorised to submit;
- attempt to gain unauthorised access to, probe, scan, hack, disrupt or interfere with the Website, its security, or any system or network connected to it;
- use any scraper, crawler, bot or automated means to access or copy data from the Website, or bypass any access restriction; or
- use the Website to distribute advertising or unsolicited communications.
We may investigate and cooperate with authorities in respect of any suspected violation, which may carry civil or criminal liability.
13. Disclaimers
THE WEBSITE AND THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, TPPL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY PARTICULAR RESULT OR CLINICAL OUTCOME WILL BE ACHIEVED.
No advice or opinion provided through a Service is a guarantee of cure, accuracy of diagnosis, or treatment outcome. Medicine involves inherent uncertainty, and reasonable practitioners may differ.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TPPL AND ITS DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE WEBSITE OR THE SERVICES. TO THE FULLEST EXTENT PERMITTED BY LAW, TPPL’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR SERVICE IS LIMITED TO THE AMOUNT YOU PAID TO TPPL FOR THAT SERVICE.
Important: Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any non-excludable right or remedy you have under the Consumer Protection Act, 2019 or other applicable law. This Section does not purport to limit the professional responsibility of any RMP to the extent that such responsibility cannot lawfully be limited.
15. Indemnity
You agree to indemnify and hold harmless TPPL and its directors, officers, employees and agents from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of: your breach of these Terms or applicable law; any content or records you submit; your misuse of the Website or Services; or your provision of false, inaccurate or unauthorised information.
16. Third parties & links
The Website may link to, or rely on, third-party websites, platforms and providers (including Facilities, payment processors and communication platforms) that we do not control. We make no representation or warranty about, and accept no responsibility for, any third party, its content, products, services or privacy practices. Your dealings with any third party are solely between you and that third party.
17. Force majeure
TPPL is not liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, epidemics or pandemics, war, civil disturbance, government action, power or network failures, or failures of third-party platforms or service providers.
18. Suspension & termination
We may suspend, restrict or terminate your access to the Website or any Service at any time, with or without cause and, where practicable, with notice — including where we reasonably believe you have breached these Terms or applicable law. You remain liable for any fees or charges incurred before termination. Provisions that by their nature should survive termination (including Sections 11, 13, 14, 15, 19 and 20) survive.
19. Governing law & dispute resolution
These Terms and any dispute or claim arising out of or in connection with them, the Website or the Services (including non-contractual disputes) are governed by the laws of India.
Subject to applicable law, the parties shall first attempt to resolve any dispute amicably. Any dispute that is not resolved within thirty (30) days may be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996; the seat and venue of arbitration shall be New Delhi, India, and the proceedings shall be conducted in English. Subject to the foregoing, the courts at New Delhi shall have exclusive jurisdiction. Nothing in this Section prevents a consumer from pursuing any remedy available under the Consumer Protection Act, 2019, or affects any right that cannot be waived under applicable law.
20. General
- Entire agreement. These Terms, together with the Privacy Policy and any service-specific terms or consents, are the entire agreement between you and TPPL regarding the Website and Services.
- Severability. If any provision is held invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision is modified to the minimum extent necessary to make it enforceable.
- No waiver. Our failure to enforce any provision is not a waiver of it.
- Assignment. You may not assign your rights or obligations without our consent. We may assign these Terms in connection with a reorganisation or transfer of our business.
- Notices. We may give notices through the Website or by e-mail to the address you provide.
